What does a contract for work and services mean in integrated design?
Design certainty
Anyone preparing a property project wants to know what design work is required, what it costs and when it will be available. A clearly defined design commission provides the foundation. In Die Planungsgruppe’s model, the entire agreed design scope is organised through one contractual partner — with binding agreements on design costs and deadlines.
What matters is what you agree
A contract for work and services generally concerns an agreed outcome. For architects’ and engineers’ contracts, the German Civil Code (BGB) contains additional provisions linked to the agreed design and supervision objectives. However, the name of the contract alone does not automatically establish a particular fixed price or completion date. The specific agreement is what matters.
For clients, this means: clarify which services and results it covers, what information the design is based on and which costs and deadlines apply.
One contract for the entire agreed design scope
At Die Planungsgruppe, this is organised through a central integrated design service. Architecture, building services, structural design and engineering, building physics, fire safety and external works / landscape design are among our core in-house disciplines.
If the project needs additional specialist design, we commission and coordinate the appropriate specialists. The client still has one contract with us for the entire agreed design scope.
The number of disciplines involved therefore does not have to become the number of design contracts the client must coordinate themselves.
What should be clarified before starting
The design scope
Which services are required? What work has already been done? Which documents form the basis? A general statement such as “the entire design” only becomes specific when the task and expected results are described.
The design costs
In the model described, we make a binding agreement on the costs for the defined design scope. This also includes clearly distinguishing design costs from the subsequent costs of construction.
The design deadlines
Deadlines should show which design services must be available by when. The decisions, documents and coordination required for the process must also be taken into account. A commitment to a design deadline is not automatically a commitment regarding the outcome of an official approval process.
Handling changes
A new use concept, additional tasks or changed project information can alter the design task. It must then be clarified what still falls within the original scope and which adjustments are needed. The contractual provisions and applicable statutory rules determine how changes are handled.
What does liability for defects mean?
Our responsibility for defects in the agreed design services is governed by the contract and applicable law. The rights and obligations in each case depend particularly on the agreed scope and the relevant legal requirements. Under certain conditions, the law governing contracts for work and services provides rights in the event of defects; this is not the same as blanket protection against every consequence for a project.
That is why it is important to look beyond a catchphrase in project discussions. Ask your contractual partner to explain what they are responsible for and how the promised services are described in the commission.
Design costs are not construction costs
If you would also like support during construction, we can introduce a suitable building contractor and provide the agreed communication, coordination, construction support and site supervision.
The construction contract is concluded directly between the client and the building contractor. That contract sets out the applicable construction services, prices and deadlines. Our design contract is therefore not a lump-sum contract for the entire building project.
The key questions for your first conversation
What decision would you like to make next? What design information is missing for that decision? Which documents are available? And which coordination tasks would you like to hand over to the integrated design practice?
These questions help structure the task so that services, design costs and deadlines can be discussed in specific terms.
